Exactly one year ago on November 7th 2024, we wrapped shooting Julian while the sun set over New York’s Rockefeller Park. Today, exactly one year later, the US Supreme Court justices are scheduled to hold a private conference in which they will discuss whether a case against same-sex marriage is worth hearing.
The Obergefell v. Hodges decision legalized same-sex marriage across the United States in 2015. This precedent protects gay couples from the whimsical decision making of conservative legislators at the state level, as it obliges every American county clerk to grant gay couples a marriage licenses. No matter the state they live in.
However, a former Kentucky county clerk who was jailed and then fined after denying a same sex couple such a license, is now attempting to make a case against the precedent.
Although many legal analysts doubt the Supreme Court will end up eventually overturning the precedent, it is important to remind these justices that the world is watching. The more eyes in their direction on the 7th of November, the less likely they are are to ruin credibility or popularity in making decisions the country (as well as the international community) doesn’t like.
If the Supreme Court chooses to hear Davis’ case and ultimately overturn Obergefell, the question of marriage equality could return to the states, potentially ending nationwide uniformity and impacting hundreds of thousands of couples. Though the chances of this happening are small, it is something we have seen happen with Roe v. Wade. And it is a strong reminder that gay rights are to be valued, reinforced and continuously protected.
