If you were to choose a trademark for your business, which one would you pick?
And what does "strong" even mean for a trademark??
Short answer: From a legal POV, fanciful trademarks are stronger than descriptive ones.
Huh? Made-up words with no meaning? Yes, it might be counterintuitive from a marketing POV. (How can a made-up word build a strong recall and recognition of your product or service?) But the reality is, there are millions of existing trademarks, and most common words have already been taken. So the more creative the mark, the easier it is to protect (generally!).
Let's break it down from the weakest to the strongest:
😢 Descriptive - simply describe the goods and services or their intended purpose
😐 Suggestive - suggest some characteristics or benefits of the product or service
🙂 Arbitrary - real words but are used in unexpected ways (like Apple for computers)
😎 Fanciful - made-up trademarks with no inherent meaning (like Kodak or Pepsi)
Trademark "strength" is only one factor in choosing a good trademark, and choosing a mark is only one step in the full trademark life cycle. We help our clients throughout all these steps!
