Today, the Center alongside, @public_counsel , @larazacentrolegalsf & @chirla_org filed a lawsuit that challenges a dehumanizing, unjust, and illegal ICE policy issued in early 2025 that, for the first time in decades, enables the widespread jailing and deportation of immigrant survivors. This policy violates the very legal protections, crafted by Congress and passed with bipartisan support, that were designed to shield vulnerable adults and children from harm. It also challenges two unlawful and ongoing practices that the 2025 policy set in motion with devastating impact: *ICE routinely imprisons and deports immigrant survivors who have been formally granted the right to remain in the U.S. *ICE regularly deports survivors of trafficking and other serious crimes without carrying out the required legal review to determine if they are eligible for protections that Congress specifically created to keep survivors safe from deportation. Immigrant survivors deserve safety, dignity, and justice, but are now being arrested, jailed, and deported. This is not just a policy failure; it is a human rights and legal crisis. Several organizations that do the courageous work of counseling and representing survivors of domestic abuse, human trafficking, and crime have also stepped forward as plaintiffs to protect the communities they serve. These include the Immigration Center for Women and Children @icwclaw , California Collaborative for Immigrant Justice @ccijustice , the Coalition for Humane Immigrant Rights, and La Raza Centro Legal. Plaintiffs are represented in this lawsuit by the Center for Human Rights and Constitutional Law, Public Counsel, La Raza Centro Legal, and Coalition for Humane Immigrant Rights. We demand that the Trump administration follow the law and respect these rights. When federal agencies violate these laws, they not only break the law - they enable ongoing abuse. Immigrant survivors must not be punished for seeking protection, and the government must be held accountable to the law. On Friday, in a major victory for the rights and dignity of immigrant children, a federal court struck down the government’s latest bid to terminate the Flores Settlement, ensuring the long-standing protections it provides will remain in force. Through our monitoring visits and court filings, in May, we found that CBP held 46 children over a week, including 6 children held for over 2 weeks and 4 children held 19 days, according to data revealed in a court filing. In March and April, CPB reported that it had 213 children in custody for more than 72 hours. That included 14 children, including toddlers, who were held for over 20 days in April. As long as children face the profound harms of immigration detention, the Center, along with co-counsel @childrensrights and @ncylnews , will remain steadfast in defending them. Judge Gee's ruling sends a clear message: immigrant children are not invisible. They will always deserve care, dignity, and full recognition of their human rights. 👉The Court has taken tomorrow's hearing in Fanfan v. Noem off calendar and will issue decisions on Plaintiffs’ motions for provisional class certification and stay of agency action based on the written arguments submitted by the parties. The Flores settlement defines the rights of immigrant children in government custody, limiting how long kids can be detained for and prioritizing family reunification where possible. But multiple administrations have violated the settlement, as the government is currently doing. In its second term, the Trump administration has detained over 6,200 children, often for much longer than the 20-day limit. Countless heartbreaking stories told by children and their families. ICE’s report does not reflect the truly traumatizing nature of being imprisoned at Dilley.
