It is not only legal, but required to disobey an order from the President of the United States if that order is illegal.
Key Points:
ā No oneāincluding the Presidentāis above the law.
The U.S. Constitution, federal laws, and military law all make it clear that unlawful orders must not be obeyed.
ā Following an illegal order can itself be a crime.
Under U.S. law and especially under the Uniform Code of Military Justice (UCMJ), individuals can be held criminally responsible for carrying out unlawful actionsāeven if āthe President told them to.ā
ā The rule of law supersedes presidential authority.
The President cannot legally order someone to break the law, violate the Constitution, or commit a crime. Such an order would be invalid the moment it is given.
Examples of illegal orders you must refuse:
Ordering someone to destroy evidence.
Ordering military or federal agents to arrest people without due process.
Ordering an attack without legal authority.
Ordering someone to discriminate or violate constitutional rights.
Bottom Line:
It is legalāand requiredāto refuse an illegal order from the President.
Obeying an illegal order can lead to personal criminal liability, while refusing one is protected under the Constitution and the principle of lawful authority.
