All pregnant people deserve to feel safe seeking care. However, across NYS, healthcare providers are drug testing and screening pregnant people without their consentāand for no medical reason. This practice deters people from seeking vital prenatal care, violates their trust and dignity, and worsens maternal and infant health outcomes ā especially for Black pregnant people and mothers.
The Maternal Health, Dignity and Consent Act would support maternal-fetal and infant health by building trust and transparency between pregnant people and their health care providers. It would affirm pregnant and postpartum patientsā right to informed consent before drug testing and screening This would align informed consent practices across the state with New York State Department of Health Guidelines and clinical best practices endorsed by leading medical societies.
NY must pass this essential reproductive and racial justice legislation to improve maternal and infant health outcomes, uphold the dignity of pregnant New Yorkers, and ensure that nothing is done to birthing people without their consent.

New York has robust, long-standing laws that already protect people leaving and entering houses of worship or reproductive health facilities. But if any of these proposals pass, protest would be restricted or banned in large swathes of the state. ā

As the Trump admin works to stifle speech and attack our right to protest, state lawmakers must stand up for New York values and defend the First Amendment.
Since January, reproductive health and justice organizations across New York State have made it clear that we stand in firm opposition to proposed buffer zones.
The legislature must prioritize protecting New Yorkers, not further the efforts to restrict our free speech.
