Convictions gained under the WRONG interpretation of the LAW. Swellings, Sorton and Cunliffe were tried under a 300-year-old law the police have successfully re-employed in the last decade to fight gang violence. The principle of this “joint enterprise” or “common purpose” doctrine is that when two or more people assault or murder, even those who DO NOT physically participate or strike the fatal blow but lend encouragement to the crime are as guilty as the main perpetrator and will receive similar punishment. It is deemed sufficient enough for another party to realise that the primary perpetrator might kill with intent or intend to cause grievous bodily harm. Although press reports of the #killing of Garry Newlove described the “gang’ as “kicking him like a football”, at the trial the jury heard he had died from a #single blow and there were no other #significant injuries to his body. #JointEnterprise continues to target vulnerable children & teenagers. With particular focus on black & mixed raced communities. The Crown Prosecution Service still cannot explain the disproportionately in their own #jointenterprise data. #killingthelaw is crucial, too many young lives have been destroyed already. #jointenterprisenotguiltybyassociation campaigners demand a full prison & probation audit so the public know exactly who we have in prison, why they are there, & for how long.Prisons are at full capacity & more & more people are being given #lifesentences because of a diabolical, policy driven common law legal doctrine that makes no common sense. @david.lammy promised on PM Questions in Parliament to meet @jengba_ CAMPAIGNERS. Did you know that here in the Uk we still give CHILDREN life sentences? That’s 99 YEARS. Yes 99 years with a minimum term they MUST serve before being eligible for parole. Did you know most children serving life sentences will be there because of JOINT ENTERPRISE ? #jointenterprise has led to children, teenagers & young adults being lifed of for #Murder when they didn’t murder anyone. They are scooped up & have their lives & futures ripped away & destroyed forever. Even when they didn’t even make a significant contribution to a crime.
