Late yesterday afternoon, Colorado passed a new law amending its existing law protecting youth from conversion therapy to address First Amendment concerns raised in Chiles v. Salazar. It also went even further: extending the statute of limitations for survivors to bring medical malpractice claims.

BREAKING: Today, the U.S. Supreme Court issued its ruling in Chiles v. Salazar, holding that Colorado’s law protecting youth from conversion therapy likely violates the First Amendment. This is being sent back to the lower courts, and Colorado will have another bite at the apple to defend against this important legislation. This is not the outcome we sought. But here is what you need to know: today’s ruling is about how conversion therapy can be regulated. It does not mean it is safe or legal. It isn’t. Conversion therapy is still medical malpractice and consumer fraud. And we are already fighting back. NCLR is working with lawmakers in California, Colorado, Maryland, Illinois, and other states to pass legislation giving conversion therapy survivors an extended window to sue for damages. We are pressing licensing boards to hold bad actors accountable. And we will continue to support survivors in bringing civil claims against the practitioners who harmed them. For thirty years, NCLR has led the legal fight against conversion therapy. The families, survivors, and advocates who have stood beside us have not given up — and neither have we.

All eyes and ears on SCOTUS tomorrow as the landmark case of Chiles v. Salazar is heard. We KNOW that bans on conversion therapy protects ALL kids. We KNOW that bans on conversion therapy protects the health and well-being of EVERYONE. We KNOW that bans on conversion therapy prevents divides amongst families and communities. We urge the Court to side with the majority of Americans who want to protect young people from conversion therapy!

This Tuesday, October 7, the Supreme Court will hear Chiles v. Salazar. This landmark case on conversion therapy will center a challenge to Colorado’s current law that protects young people from unethical therapists who claim they can change their sexual orientation or gender identity if they just “try hard enough.” There have been a lot of myths circling around about what conversion therapy is. We can all agree: Kids should be happy, healthy, and given the ability to THRIVE. Therapists who use conversion practices work against this. Conversion "therapy" is a dangerous and discredited practice that seeks to change someone’s sexual orientation or gender identity. On October 7, 2025, SCOTUS will be hearing Chiles v. Salazar, which will decide if banning conversion practices infringes on a therapist's free speech.

Today Health and Human Services published a report that attacks the evidence-based standards of care for transgender youth and throws the weight of the federal government behind dangerous, discredited conversion therapy practices—which they are now calling “exploratory therapy.” This report is not based on science, even though it pretends to be. It’s an agenda-driven political attack on transgender young people and their families. BEING TRANSGENDER IS NOT A CHOICE! No amount of talk or pressure can change this part of someone.

This fall, SCOTUS will hear oral arguments in Chiles v. Salazar - a case that will determine if a Colorado law that prohibits state-licensed mental health professionals from using dangerous conversion practices on minors violates the free speech clause of the first amendment. This means that the ban in place currently is at risk of being overturned. So - what is conversion "therapy" and why is it so dangerous? - Conversion “therapy” is a dangerous and discredited practice that is committed by fringe therapists in an attempt to change LGBTQ kids. We use quotes, because it is not in fact therapy. - Ultimately, conversion “therapy” hurts LGBTQ youth. Someone doesn’t choose to be a gay or trans – it is not a lifestyle or choice, and as such, no amount of talk or persuasion can make an LGBTQ person not LGBTQ. - Conversion therapy is a huge risk, because using a position of trust as a therapist to change an unchangeable part of someone puts kids at high risk of suicide attempts.
