⬇️ Here’s what actually happened
🗓️ TODAY the DOJ moved certain marijuana products from Schedule I to Schedule III. Effective immediately.
This is happening in phases.
✅ PHASE 1 - today:
→ FDA-approved drug products containing marijuana
→ State-licensed MEDICAL marijuana products
❌ NOT covered:
→ Adult use / recreational
→ If your state legalized it for everyone over 21, that market is still federally illegal.
📅 PHASE 2 - June 29, 2026:
A new expedited hearing begins to consider rescheduling ALL cannabis. Once a final rule publishes, there’s a 30-day window before it takes effect and legal challenges are expected. Courts could issue a stay that delays implementation for months or longer.
💰 What about taxes?
The order says nothing about 280E. But 280E only applies to Schedule I and II substances. State-licensed medical operators just moved to Schedule III today. That means those businesses may no longer be subject to 280E right now - not because DOJ said so, but because of how the law works. No guidance yet. Watch this space.
⚖️ And for the communities most harmed by 56 years of Schedule I - criminalized while others built wealth in this space - this order says nothing.
Progress is progress.
But the finish line isn’t here yet and the people who paid the highest price are still waiting.
