🚨Smell ≠ Probable Cause — Know the Game, Protect Yourself🚨Let’s keep it a buck. 💨A lot of jurisdictions have updated their laws — they’ll tell you that the smell of “green” alone isn’t enough for a stop, search, or arrest. But on these streets? Too many officers are still using that as their go-to excuse.
As a civil rights attorney and green operator, I’m telling you — this is where the law on paper and the law in practice don’t always line up. The “odor pretext” is still being abused, and it’s putting people — especially Black folks — in harm’s way every day.
📝 Know your rights: • In many states (including Maryland), the smell alone is not probable cause. • You can refuse a search if there’s no other basis. • Ask if you’re being detained or if you’re free to go. • Keep calm, record when possible, and protect yourself legally.
🚗 Move smart: • Keep your bud in sealed containers, ideally in the trunk. • Avoid open bags, ashtrays, or loose flower in the cabin. • Have your IDs, medical cards, or receipts in order. • Don’t give them extra excuses.
And let’s be real — this ain’t new. From 1865 to 1950, over 6,500 Black lives were taken through racial terror lynchings — including documented cases here in St. Mary’s County. Back then, accusations were the weapon. Today, it’s often “odor.” Same tactics, new script.
⚠️ So be sharp, be lawful, and don’t let them twist the narrative.
The system doesn’t always play fair — but knowing the rules and moving wisely is how we keep each other safe.
